County officials oppose letting residents set off their own fireworks.
During the 4th of July, many municipalities stage fireworks shows. However, some towns, including Medicine Bow, allow the public to set off their own pyrotechnics under the supervision of firefighters.
During Tuesday’s Board of Carbon County Commissioners meeting, Fire Warden John Rutherford said residents have asked him about establishing a location to legally shoot their fireworks. Rutherford said he opposes the idea due to safety and logistical concerns.
Fire Warden Rutherford is referring to Matthew Lynch, who tried to light a firework and throw it outside a Gillette bar. The device detonated instantly, severely damaging his hand and injuring four other people.
The county fire warden encouraged the public to attend one of the many free fireworks shows held throughout the county.
Later in the meeting, Commissioner John Johnson said he agreed with Fire Warden Rutherford’s position on the use of fireworks.
Fireworks are illegal in Carbon County under Resolution 1981-8. The provision states that it is unlawful for any person to possess, store, sell, or use fireworks without a permit from the county fire warden. The ban applies to all unincorporated areas and surrounding public lands of Carbon County. Violators may be fined up to $500 and sentenced to a maximum of 90 days in jail.
Technically, towns are also under the jurisdiction of the county’s fireworks ban. However, Wyoming State Statute 35‑10‑205 gives municipalities the authority to adopt rules that are more or less restrictive than the surrounding county. As a result, towns can host their own fireworks shows without seeking a permit from the fire warden as long as the county is not under fire restrictions. Municipalities within Carbon County also have their own fireworks rules, preventing residents from setting them off outside of sanctioned events and locations.
As it stands, the sale and use of fireworks will remain illegal in Carbon County, according to Fire Warden Rutherford.
